NxtQue is a subscription-based queue management and appointment booking platform designed for service businesses including barbershops, hair salons, nail salons, spas, tattoo studios, and other personal service businesses ("the Service"). The Service includes live queue management, appointment booking, SMS client notifications, invoicing, a client CRM, analytics, and a professional discovery page.
NxtQue is operated by NxtQue ("we," "us," or "our"). These Terms govern your use of the Service as a shop owner, professional (barber, stylist, nail tech, tattoo artist, therapist, or similar), or client.
You must be at least 18 years old to create an account. By creating an account, you represent that you are 18 or older and that all information you provide is accurate and current. Clients may book services without an account but must provide accurate contact information.
You are responsible for maintaining the confidentiality of your login credentials and staff PINs. You are responsible for all activity that occurs under your account. Notify us immediately at support@nxtque.com if you suspect unauthorized access to your account.
Portable professional profiles: Each professional on the platform maintains their own portable profile. Professionals own their profile, service menu, portfolio photos, and client history — not the shop owner. If a professional leaves a shop, their data travels with them and remains accessible through their own account.
NxtQue offers the following subscription plans:

Annual plans are billed as a single payment and include 2 months free (approximately 17% savings). All prices are in USD and exclude applicable taxes.
Subscriptions renew automatically at the end of each billing period. You authorize NxtQue to charge your payment method on file for each renewal. You can cancel at any time from your account settings or by contacting billing@nxtque.com.
New accounts receive a 14-day free trial with full access to all features on your selected plan. A valid payment method is required to start a trial. Your card will not be charged until the trial period ends. If you cancel before the trial ends, you will not be charged. At the end of the trial, your subscription begins automatically on your selected plan.
NxtQue charges a flat monthly or annual subscription fee only. We do not take a commission or percentage of your service revenue. The only transaction fees that apply are:

Violation of these terms may result in immediate suspension or termination of your account without refund.
Opt-in: By voluntarily providing your mobile phone number in the NxtQue booking or walk-in queue form and checking the SMS consent checkbox, you consent to receive transactional SMS messages from NxtQue. Providing a phone number is not required to use the service. The consent disclosure is displayed at the point of opt-in. View the full opt-in flow at nxtque.com/sms-opt-in.html.
Message types: NxtQue sends transactional SMS only — queue position alerts, booking confirmations, appointment reminders, payment receipts, and rebooking reminders initiated by your service professional. No marketing or promotional messages are sent via SMS.
Message frequency: Message frequency varies based on activity. Typically up to 4 messages per visit or booking. Rebooking reminders are sent at most once per visit cycle when manually triggered by a professional.
Rates: Message and data rates may apply. NxtQue is not responsible for charges from your mobile carrier.
Opt-out: Reply STOP to any NxtQue message at any time to unsubscribe. You will receive one final confirmation and no further SMS will be sent. Reply HELP for support contact information. You may also manage notification preferences in your NxtQue account settings.
Supported carriers: Major US carriers including AT&T, Verizon, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.

As a shop owner or professional, you are responsible for how you use client data collected through NxtQue. You may use client contact information only to communicate about services booked through NxtQue. You may not share, sell, export, or misuse client contact information for any other purpose. Booking deposits collected through NxtQue are governed by Stripe's terms of service.
We strive for high availability but do not guarantee uninterrupted service. NxtQue is not liable for losses resulting from downtime, data loss, or technical failures beyond our control. We will notify users of planned maintenance where reasonably possible.
NxtQue, its logo, design, software, and platform code are owned by NxtQue and protected by applicable intellectual property laws. You retain full ownership of all content you upload to the platform, including photos, service descriptions, and portfolio work. By uploading content, you grant NxtQue a non-exclusive, royalty-free license to display that content within the platform and on the NxtQue discovery page for the purpose of operating the service.
To the maximum extent permitted by applicable law, NxtQue shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to lost revenue, lost clients, or data loss. Our total liability to you for any claim arising under these Terms shall not exceed the total amount you paid to NxtQue in the 3 months immediately prior to the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless NxtQue and its officers, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraudulent activity, non-payment, or behavior that harms other users or the integrity of the platform. You may terminate your account at any time. Upon termination, your data will be retained for 90 days and then permanently deleted per our Privacy Policy.
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of NxtQue shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be handled in the state or federal courts of Maryland. You waive any right to a class action lawsuit against NxtQue.
We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of NxtQue after changes are posted and the notice period has passed constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
